An estate without a will falls under intestate law which is governed by the Intestate Succession Act, 1987 (Act 81 of 1987). When an estate falls under this law, distributions from the estate have to follow a specific order.
The estate will be divided amongst the surviving spouse, children, parents or siblings according to a set formula.
In many cases these intestate law distributions place unnecessary hardships on a family or dependents. As an accountant you are in a position to advice your clients on how to draft a will ensuring that all the requirements for a will to be considered an enforceable document are met.
