Overview   

A lot of South African businesses are collapsing from financial distress. In the first half of 2021 alone, there were 997 liquidations of companies and close corporations! The effect of this is devastating to an economy that is battling to climb out of the effects of the COVID-19 pandemic. 

Accountants, as do attorneys, can follow a legal process called business rescue to save financially distressed businesses from going into liquidation. Through this process, licensed practitioners can take vital steps to turn around, restructure, and ultimately save troubled businesses.

Obtaining your CPD certificate 

This training is compliant with the International Education Standard (IES7) issued by the International Federation of Accountants and recognised for CPD by relevant professional bodies including ACCA, CIMA, IAC, IIA, SAIBA, SAICA and SAIPA. 

 All attendees are issued with a CPD certificate available in an online profile.   


About the presenters 

Nastascha Harduth 

Nastascha Harduth is a Director and has been with Werksmans since 2008. She was admitted in 2010 and has been a director within the firm’s Insolvency, Business Rescue and Restructuring practice since 2014. Her legal practice focusses on business rescue and restructuring matters, but she has wide ranging experience in corporate insolvencies, dispute resolution and commercial litigation, as well as corporate debt recoveries. Nastascha often advises on the duties and responsibilities of directors, the risk of incurring personal liability, and how to mitigate it.  

Her experience extends well beyond the South African jurisdiction, and includes cross border experience in the United States of America, Mauritius, Seychelles, Zambia, Botswana and Lesotho. Nastascha regularly writes for various publications and contributes to the media. She is a member of the South African Restructuring and Insolvency Practitioners Association (and is a fellow of INSOL International, where she is extensively involved, sitting on the INSOL Fellows Steering Committee, the INSOL Webinar Committee, and on the INSOL Touchpoint Newsletter's Editorial Committee. 

 

Eric Levenstein 

Eric Levenstein has been a director of Werksmans Attorneys since 1993 and is the head of the firm’s Insolvency, Business 

Rescue Restructuring practice. He specialises in litigation and dispute resolution with a particular focus on business rescue, 

insolvency and restructuring, banking and finance and corporate recovery of debt. His expertise extends to director liability issues. He regularly delivers seminars and writes for various publications on these topics among others. He is the Chairperson of the South African Restructuring Insolvency Practitioners Association SARIPA and sits on the board of INSOL International, a worldwide group of insolvency practitioners. Eric has BCom and LLB degrees, Higher Diplomas in Company Law and Tax, a Diploma in Insolvency Law and a Doctorate of Laws in Business Rescue. 

 

Lauren Becker 

Lauren Becker has been a Director at Werksmans since March 2016 and works in the firm’s Litigation Dispute Resolution 

practice She specialises in insolvency, business rescue restructuring advisory and litigation and represents clients in various 

commercial and general litigious matters. She has a keen interest in the field of business rescue and has advised various 

stakeholders in the process, in respect of commercial matters related to companies in business rescue and in respect of litigation related to companies in business rescue. She has authored several articles on the topic of business rescue and has given various presentations to clients, companies and organisations 

 

Roxanne Webster 

Roxanne Webster is a Senior Associate in the Insolvency, Business Rescue Restructuring practice and was admitted as an 

Attorney and Notary Public in 2016. Her experience spans across advising financial institutions and creditors in insolvency related proceedings assisting and advising clients on business rescue proceedings and general corporate recovery and commercial litigation.
