Block exemption - Essential goods logo

Essential goods include the final good itself as well as all inputs in the supply chain required for the production, distribution and retail of the essential goods.

In the main, these block exemptions, put a waiver on the application of sections 4 and 5 of the Competition Act as amended. The regulations came into effect on 15 July 2021.

The block exemptions refer to the following essential goods: basic food and consumer items, emergency products, medical and hygiene supplies (including pharmaceutical products), refined petroleum products and emergency clean-up products. It includes the final goods as well as all inputs in the supply chain required for the production, distribution and retail thereof.

The exemptions are limited only to communication and coordinating activities, which have the sole purpose of responding to actual and anticipated shortages for essential goods in general, or in particular areas of the country, arising from disruptions to the supply chains for essential goods.

The Competition Commission has published a media statement welcoming the block exemptions – refer to https://www.compcom.co.za/wp-content/uploads/2021/07/COMMISSION-WELCOMES-BLOCK-EXEMPTIONS-FOR-ESSENTIAL-GOODS.pdf
