Draft amended Regulations 4 of the Consumer Protection Act: Direct Marketing logo

Summary:

The amended Regulations 4 of the Consumer Protection Act have been published in the Government Gazette, giving interested parties until 15 January 2024 to submit their comments.

Article:

Regulations 4 of the CPA provides mechanisms to block unwanted direct marketing communication.

SA consumers are constantly exposed to intrusive marketing, and this has significantly increased over the years.

The amended legislation will establish an opt-out registry administered by the National Consumer Commission (NCC).

This will allow consumers to register a pre-emptive block by completing the provided form.

With the Opt-Out Registry, direct marketers must be registered and should ensure that when contacting any consumer for direct marketing that they do not contact any consumer that has registered on the Opt-Out Registry.

The amended regulations set out requirements that direct marketers must comply with.
